These Terms and Conditions (“Terms”) govern the use of services provided by DuPage County Legal Courier (“Company,” “we,” “our,” or “us”). By requesting or using our services, you agree to these Terms.

1. Services Provided

DuPage County Legal Courier provides:

  • Court filings with the DuPage County Clerk of the Circuit Court

  • Clerk pickups

  • Legal document delivery

  • Rush and same-day courier services

  • Multi-stop and scheduled courthouse runs

  • Document retrieval (where permitted)

All services are subject to availability during court business hours unless otherwise agreed.

2. Service Requests and Dispatch

Service requests may be submitted by phone, email, or website form.

A service is considered confirmed once dispatch is acknowledged by the Company. Estimated arrival times (ETAs) are provided in good faith but are not guaranteed due to traffic, court volume, weather, or unforeseen delays.

3. Client Responsibilities

Clients are responsible for:

  • Providing accurate pickup and delivery information

  • Ensuring documents are properly prepared for filing

  • Confirming correct court location, case numbers, and filing instructions

  • Ensuring compliance with court rules and deadlines

The Company is not responsible for rejected filings due to incorrect documentation, insufficient copies, improper formatting, or court rule violations.

4. Court Filing Limitations

Court filings are subject to:

  • Clerk acceptance policies

  • Filing cut-off times

  • Court operational hours

  • Processing delays

While we make every reasonable effort to meet deadlines, the Company does not guarantee court acceptance or processing speed.

5. Fees and Payment

Pricing is based on the rates published or quoted at the time of service.

Additional charges may apply for:

  • Wait time due to clerk processing

  • Tolls and parking

  • Mileage outside DuPage County

  • Additional stops

  • After-hours or emergency services

Payment terms may be per-run or monthly retainer, as agreed. Unpaid balances may result in suspension of service.

6. Retainer Agreements

Retainer services are billed monthly and are month-to-month unless otherwise agreed in writing.

Unused included runs do not roll over unless explicitly stated. Additional runs beyond included amounts are billed at agreed discounted rates.

7. Limitation of Liability

DuPage County Legal Courier is not liable for:

  • Court rejection of filings

  • Clerk processing delays

  • Indirect or consequential damages

  • Loss resulting from inaccurate instructions

  • Delays caused by traffic, weather, court closures, or force majeure events

Our liability, if any, shall be limited to the amount paid for the specific service in question.

8. Confidentiality

We handle legal documents professionally and discreetly. However, clients remain responsible for compliance with confidentiality laws and secure transmission of sensitive information.

9. Cancellations

If a run is canceled after dispatch, a cancellation or trip fee may apply.

10. Website Use

Website content is provided for informational purposes only. Unauthorized copying, reproduction, or misuse of content is prohibited.

11. Governing Law

These Terms are governed by the laws of the State of Illinois. Any disputes shall be resolved in the appropriate courts located in DuPage County, Illinois.

12. Changes to Terms

We reserve the right to update these Terms at any time. Updated versions will be posted with a revised effective date.
